This Order prohibits the use of phthalates as a substance or as a constituent of chemical products in the manufacture of toys and toddler’s articles or parts thereof in concentrations above 0.05% by mass. It is also prohibited to import or sell toys and toddler’s articles or parts thereof containing phthalates in concentrations above 0.05% expressed in mass.

The Order amends and replaces Order No. 855 of September 5, 2009 on the Prohibition of Phthalates in Toys and Toddlers. The reason is that, in December 2018, the Commission decided that another phthalate should be subject to a ban in Regulation No 19072006 / EC of the European Parliament and of the Council of 18 December 2006 (the REACH Regulation).
