On December 16th, New York Governor Andrew Cuomo has signed SB 4046 to set warning requirements on children’s jewelry containing lead.

This approved bill requires that children’s jewelry which contains lead above 40 ppm, but below the federal limit, carry a warning label. The warning at a minimum must contain: “Warning: Contains lead. May be harmful if eaten or chewed. Complies with Federal Standards”. The warning is required beginning January 1st, 2021.

The bill defines children’s jewelry as jewelry that is made for, marketed for use by, or marketed to, children and includes jewelry that meets any of the following conditions:

  • Represented in its packaging, display, or advertising, as appropriate for use by children.
  • Sold in conjunction with, attached to, or packaged together with other products that are packaged, displayed, or advertised as appropriate for use by children.
