The government announced the SNAc provisions in a Canada Gazette notice for the use of graphene above certain quantities in consumer products or cosmetics applied as a spray, mist or aerosol.
The SNAc imposes notification requirements for:
- the manufacture of a consumer product or cosmetic that is applied as a spray, mist or aerosol containing graphene in a concentration above 0.1% by weight; or
- the distribution for sale of the above if the total quantity involved in a single year is greater than 10kg.
Under the order, businesses are obligated to notify the environment ministry at least 90 days before engaging in relevant new uses of the substance, if these meet the specific criteria. Regulators could then assess whether the new activity constitutes a risk and determine whether risk management action is necessary.
