On October 1, 2018, Oregon Health Authority (OHA) has enforced the amendments made under OAR 333–016-2060 Toxic Free Kids Rule Revision.

This amendment amends the List of Chemicals of High Concern for Children’s Health which includes the modifications to its list of reportable substances and other changes to its fees and notification requirements.

The amendment specifies the following:

  • Need for only one report (biennial notification) of a specific children’s product
  • Establish a hierarchy of persons or entities the Authority will hold primarily responsible for reporting and with respect to enforcement
  • Aligned rule with existing statute to require that the number of children’s products sold or offered for sale in Oregon that contains an HPCCCH must be part of a biennial notification
