Washington Governor Jay Inslee signed into law HB 2658 Act Relating to the Use of Perfluorinated Chemicals in Food Packaging.

This Act bans the manufacturing, sale and use of food packaging containing perfluoroalkyl and polyfluoroalkyl substances (PFAS) by January 1, 2022.

The Act, however, may not take effect until the Department of Ecology identifies a safer alternative. This Act mandates that the Department conducts an alternative analysis of the substances’ used in paper, paperboard, or fibre-based materials intended for direct food contact.

A report must be submitted to Washington State Register by January 1, 2020. A yearly evaluation of a safer alternative must be done by the Department as part of the PFAS chemical action plan.
